Terms of Use
The short version: Gone This Far™ is a free app that shows statistics about workouts already in your Apple Health. It isn't medical advice, its numbers are estimates, tips are voluntary and unlock nothing, and your data stays on your device. Please read the full terms below.
1. Agreement to These Terms
These Terms of Use ("Terms") are an agreement between you and Intersog, Inc. ("Intersog," "we," "us," or "our") and govern your use of the Gone This Far™ iOS application (the "App") and the website at gonethisfar.app (the "Site"). By downloading, installing, or using the App, or by using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App or the Site.
You must be old enough to agree to these Terms where you live, or have a parent or guardian agree on your behalf.
2. License to Use the App
The App is licensed, not sold, to you. It is provided under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA. If these Terms conflict with the Standard EULA about the App, the Standard EULA controls.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
The App is free. We may update, change, or stop offering the App or any feature at any time, and we're not obligated to provide updates.
3. Health and Safety
The App is not a medical device and does not provide medical advice. It shows statistics, comparisons, and badges based on workouts already recorded in Apple Health. It does not diagnose, treat, monitor, or prevent any disease or condition, and it should not be used for medical decisions.
Consult a qualified healthcare professional before starting or changing an exercise program, particularly if you have a medical condition. Badges, streaks, and milestones are for fun and motivation only. Don't push beyond safe limits to earn one. Listen to your body, rest when you need to, and stop exercising and seek help if you feel pain, dizziness, or shortness of breath.
4. Accuracy of Statistics
The App's numbers depend on the data your devices and other apps saved to Apple Health, which may be incomplete or inaccurate. Several figures are estimates, including race times (calculated from a workout's average pace), merged duplicate workouts, triathlon and brick detection, and comparisons with real-world distances. The starting point on the globe is an approximation based on your device's time zone, not your actual location.
Don't rely on the App for official race results, training decisions that affect your safety, or any purpose where accuracy is critical.
5. Your Data
With your permission, the App reads workout data from Apple Health and processes it on your device. We do not collect, receive, or store your health data, and the App does not write to Apple Health. You can revoke access at any time in iOS Settings. The Privacy Policy explains this in detail and forms part of these Terms.
You're responsible for the security of your device. If you delete the App, its locally cached data is deleted with it.
6. Optional Tips
The App may offer optional in-app purchases described as tips (for example, "Coffee," "Sandwich," or "Lunch for the Team"). Tips are voluntary contributions to support the App. They are consumable, don't unlock features or content, and don't entitle you to support, goods, or services. Prices are shown in the App before you buy.
All purchases are processed by Apple and are subject to Apple's terms. We never receive your payment information. Refund requests are handled by Apple at reportaproblem.apple.com.
7. Feedback and Feature Votes
If you vote for a feature or send us ideas, suggestions, or other feedback, including by email, you agree we may use it for any purpose without restriction or compensation to you. Voting doesn't guarantee a feature will be built. Please don't include confidential information or health details in feedback.
8. Sharing Your Stats
The App can create images of your statistics for you to save or share. Nothing is shared unless you choose to share it. You're responsible for what you share and with whom, and for complying with the terms of any service you share to. Shared images may reveal information about your activity, so share thoughtfully.
9. Acceptable Use
You agree not to:
- copy, modify, distribute, sell, or lease the App, except as allowed by the Standard EULA or law;
- reverse engineer, decompile, or try to extract the App's source code, except where the law allows it despite this restriction;
- remove or alter any trademark, copyright, or other notice;
- use the App or Site unlawfully, or in a way that could harm us, the App, the Site, or others; or
- misrepresent images created with the App, such as by presenting sample data or edited statistics as genuine achievements for commercial gain.
10. Intellectual Property
The App, the Site, and their content, design, graphics, and software are owned by Intersog or its licensors and are protected by intellectual property laws. Except for the license in Section 2, no rights are granted to you.
Gone This Far™ (U.S. Serial No. 99784570) and the Gone This Far logo are trademarks of Intersog, Inc. You may not use them without our prior written permission, except to refer to the App accurately.
The Earth imagery in the App and on the Site is based on NASA's Blue Marble collection, which is in the public domain. Apple, Apple Watch, iPhone, and HealthKit are trademarks of Apple Inc., registered in the U.S. and other countries.
11. Third-Party Services and References
The App relies on Apple services, including Apple Health and the App Store, which are governed by Apple's own terms. It can also work with data that third-party apps saved to Apple Health. We aren't responsible for third-party services, apps, or websites, including those linked from the Site.
The App and Site mention real-world places, routes, landmarks, and events (for example, the English Channel, the Appalachian Trail, or a grand tour cycling race) only to describe distances. These references don't imply any affiliation with, or endorsement by, the owners or organizers of those places or events. All other trademarks belong to their respective owners.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the App and the Site are provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We don't warrant that the App or Site will be uninterrupted, error-free, secure, or that any statistics will be accurate or complete.
Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
13. Limitation of Liability
To the maximum extent permitted by law, Intersog and its affiliates, officers, employees, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or personal injury arising from exercise or activity, arising out of or related to the App or the Site, however caused and under any theory of liability, even if advised of the possibility of such damages.
Our total liability for all claims relating to the App and the Site is limited to the greater of the amount you paid us through tips in the twelve months before the claim or fifty U.S. dollars (US $50).
Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence where that can't be excluded. If you are a consumer in the EU or UK, you keep all rights you have under mandatory consumer protection law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Intersog from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or Site or your violation of these Terms.
15. Apple-Specific Terms
If you downloaded the App from Apple's App Store, you and we acknowledge that:
- These Terms are between you and Intersog only, not with Apple Inc. ("Apple"). Intersog, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support for the App. Intersog provides support as described on our support page.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs, or expenses due to a failure to conform to a warranty are Intersog's responsibility, to the extent not disclaimed in these Terms.
- Intersog, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws, including in connection with the App's use of HealthKit.
- If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Intersog, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
16. Termination
You can stop using the App at any time by deleting it. Your license ends automatically if you fail to comply with these Terms. When it ends, you must stop using and delete the App. Sections 4 and 7 through 19 survive termination.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you and we consent to their jurisdiction. If you are a consumer living outside the United States, you may also have the right to bring proceedings in your local courts and to rely on the mandatory laws of your country of residence.
Before filing a claim, please contact us at support@intersog.com so we can try to resolve the issue informally.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above, and for material changes we'll give reasonable notice on the Site or in the App. Continuing to use the App or Site after changes take effect means you accept the updated Terms.
19. General
These Terms, together with the Privacy Policy and the Standard EULA, are the entire agreement between you and us about the App and Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
